H.R. 45 Blair Holt’s Firearm Licensing and Record of Sale Act of 2009

To provide for the implementation of a system of licensing for purchasers of certain firearms and for a record of sale system for those firearms,and for other purposes.

H.R. 45, Blair Holt’s Firearm Licensing and Record of Sale Act of 2009, would require federal licensing for possession of any "qualifying firearm," which means a handgun (of any action type) or of any semi-auto firearm (rifle, pistol or shotgun) "that can accept any detachable ammunition feeding device."

This is a good case in point of what was presented in our orientation last month and on Tuesday; the definition would apply regardless of the size of any "feeding device" available or any other characteristics of the gun, so it would include things like Olympic target pistols and Remington semi-auto deer rifles, as well as guns far more suitable for defensive use.

The licensing system would require photographs and fingerprints, as well as a written test on gun safety, gun storage, gun laws, and "any other subjects, as the Attorney General determines to be appropriate."
Applicants would have to give the Attorney General a full release of mental health records. If a license holder fails to notify the AG of his change of address within 60 days, he would be subject to a five-year prison term and a $250,000 fine.

The bill would also require a federal record of sale for transfer of all "qualifying firearms," and just to make the point clear, it would repeal the federal ban on creating a gun registration system.

Owners of "qualifying firearms" would have to report theft or loss within 72 hours after discovery.

Any transfer of any kind of firearm would have to go through a federally licensed dealer.
